SENSAY Privacy Policy

  1. Introduction
    This Privacy Policy (“Policy”) describes how Sensay LLC (“Sensay,” “we,” “us,” or “our”) collects, uses, discloses, and protects your information through the Sensay mobile application, website, and associated services (collectively, the “Services”).

    We are committed to protecting your privacy and ensuring compliance with all applicable laws, including the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and the Children’s Online Privacy Protection Act (COPPA).
     

  2. Definitions

    • ​Personal Data: Any information that identifies or can be used to identify you.

    • Usage Data: Technical data collected from your device when using the Services.

    • Processing: Any operation performed on personal data, such as collection, storage, or deletion.​

    • Third-Party Services: External platforms or tools we use to deliver features (e.g., Firebase, Google APIs).
       

  3. Types of Data Collected

    • Personal Data
      First name, last name, email address, username, password, biometric heart rate data,  missions, badges and any journal entries or stats you log in the app.

    • Usage Data
      IP address, device type, OS version, browser type, app version, crash logs, and interaction data.

    • Location Data (if enabled)
      We may collect location-based data for specific features (e.g., live leaderboard, player vs class).

    • Authentication Data
      Login tokens, OAuth IDs, and hashed credentials via Google API.
       

  4. How We Process Your Data
    We process your data on secure, encrypted servers using both automated and manual methods. Processing occurs via Firebase, Google APIs, and analytics providers like Google Analytics. We use industry-standard encryption, access control, and token-based authentication to protect your data. All transmissions are secured using HTTPS and TLS protocols.
     

  5. Legal Basis for Processing (GDPR)
    We rely on the following legal bases for processing your personal data:

    • ​Consent: When you register, enable features, or agree to data collection (e.g., heart rate tracking).

    • Contractual Necessity: To deliver features you’ve requested (e.g., login, account creation).

    • Legitimate Interests: To analyze usage and improve our app, provided it doesn’t override your rights.

    • Legal Obligation: When required to comply with legal requests, audits, or regulations.
       

  6. Where Your Data Is Processed
    Data is stored and processed in the United States. For users in the EU/EEA, we use Standard Contractual Clauses (SCCs) to ensure adequate protection of your data when transferred internationally, as required under GDPR.
     

  7. Data Retention
    We retain personal data until you delete your account. Usage data is retained for up to 36 months or more.

    • ​We retain personal data as long as your account is active.

    • If your account is inactive for 24 months, we may delete it after prior notification.

    • Usage data is retained for up to 36 months or more for analytics.

    • Data may be retained longer to comply with legal obligations.
       

  8. Your Rights and How to Exercise Them
    You have the right to:

    • ​Withdraw consent

    • Access and obtain a copy of your data

    • Rectify incorrect or outdated data

    • Delete your account and personal data

    • Restrict or object to processing

    • Receive your data in a portable format (Data Portability)

    • Lodge a complaint with your local data protection authority

  9. Processing of Personal Data

    • Data Security
      We take appropriate technical and organizational measures to protect your personal data, including:

      • ​End-to-end encryption

      • Role-based access controls

      • Secure authentication tokens

      • ​Regular audits and monitoring

      • However, no system is 100% secure. You acknowledge that you use the Services at your own risk.

    • Analytics
      We use Google Analytics to analyze usage of the Sensay App.

    • Contacting the User
      We may contact you through email or push notifications to provide information about the Sensay App and to communicate with you about our services.

    • Displaying Content from External Platforms
      The Sensay App may display content from external platforms, such as videos from YouTube. These external platforms may collect usage data and cookies when you view their content.

    • Interaction with External Social Networks and Platforms
      The Sensay App may allow you to interact with external social networks and platforms, such as Facebook and Twitter. These external platforms may collect usage data and cookies when you interact with them.

    • Managing Contacts and Sending Messages
      The Sensay App may allow you to manage your contacts and send messages to other users. We will process the personal data of these users solely for the purpose of facilitating communication between users.

    • Registration and Authentication
      The Sensay App uses Google API for registration and authentication purposes. When you register, Google API collects your personal data to create an account and authenticate your identity.

    • Traffic Optimization and Distribution
      We may use content delivery networks and other third-party service providers to optimize and distribute the Sensay App.

    • User Database Management
      We use Firebase to manage our user database and process personal data of our users to maintain their accounts.
       

  10. California Privacy Rights
    If you are a California resident, you have the right to:

    • Know what categories of data we collect and why

    • Request access to your data

    • Delete your personal data

    • Opt out of the “sale” or “sharing” of your data (we do not sell personal data)

  11. Children’s Privacy (COPPA)
    The Sensay App is not intended for children under 13, and we do not knowingly collect personal data from children. If we learn that we have collected data from a child under 13, we will delete it immediately.
